Permanent Disability

Philadelphia Permanent Disability Attorney

If you are permanently disabled in the Philadelphia area, you may need legal assistance in applying for and obtaining permanent disability benefits. If so, we urge you to contact a Philadelphia permanent disability lawyer at The Bernstein Law Offices.  At our law firm, we are dedicated to fighting for the rights of the disabled. We have a thorough understanding of disability law and have effectively represented clients in court who were denied their disability benefits.

What is a permanent disability?

A private insurance company may have its own definition of what constitutes permanent disability as opposed to how it is defined by the Social Security Administration.  Generally, the term "disability" means that the individual has a physical or mental impairment from which he or she will not recover and will prevent said person from not only being able to work at their previos job, but any job in the national economy.  It may be necessary that the condition has lasted for a certain period of time or is expected to last a certain period of time.  The Social Security Administration requires that the impairment has lasted or is expected to last at least 12 months.

Many of our clients suffer from severe medical condition and are puzzled that they are denied benefits based upon the severity of their condition.  The Social Security Administration as well as private long term disability policies have a very narrow definition of what constitues disability.  For this reason, it is not uncommon to be denied disabililty during the initial appication for benefits.

Certain medical conditions which are often easily approved for disability benefits may include the loss of a limb, paralysis, or blindness. Other types of medical conditions are more difficlt to prove in terms of their disabling effects such as mental disorders or certain autoimmune disorders.  Having an experienced Philadelphia permanent disability attorney in your corner can have a major impact on the outcome of your claim. We will work with you and your medical providers to document the severity of your condition and demonstrate that it is supported by objective medical evidence.

Whether you are making a permanent disability claim with the Social Security Administration or a priivate insurance company for long term disability benefits, we have the experience to assit you through this difficult process.

Do you need help with a permanent disability claim? Contact a Philadelphia Permanent Disability Lawyer at our firm for experienced and effective assistance today!
