Social Security Disability Overpayments

Philadelphia Disability Lawyer

Receiving a Notice of Overpayment from the Social Security Administration (SSA) can be a frightening experience.  You may be required to return thousands of dollars to the Social Security Administration because of an overpayment of your Social Security Disability monthly benefits.  If you are in the Philadelphia area and have received a Notice of Overpayment from the SSA, you must act promptly to avoid having repayment money taken out of your future checks.

If you disagree with the amount of the overpayment or you feel that you did not receive an overpayment, you can file a reconsideration with the SSA.  You should file a reconsideration immediately stating that you disagree with the amount of the overpayment.  You should request that they do not take any money out fo your monthly check until a final decision has been made.  You can also request a Waiver if you receive an overpayment notice.  You must prove to the SSA that you were not at fault by receiving the overpayment and that you have no way of paying back the money.  A third option is to negotate a payment plan with SSA if you receive an overpayment notice.

SSA will send you a notice with regard to your reconsideration or waiver request.  AN adverse decision can be appealed and must be done in a timely manner.  You may wish to talk to a Philadelphia social security disability attorney at The Bernstein Law Officesto discuss your options if you receive a Notice Of Overpayment from the Social Security Administration.
